Shot by Sèverine Terms and Conditions

Terms and conditions for commissioning and reproduction of any photo taken by Shot by Sèverine / Sèverine Howell-Meri.

1. Definitions

  • “Picture”: Refers to any photograph, transparency, negative, digital scan, design, artwork, painting, montage, drawing, engraving, or other visual item offered for reproduction.

  • “Reproduction”: Any form of publication or copying of a picture, in whole or part, through print, digital, projection (public or private), xerography, illustration, presentation, or any other method of electronic or mechanical reproduction or storage.

  • “The Client”: The person or organisation receiving the invoice, regardless of whether they are acting on behalf of a third party.

  • “The Photographer”: Shot by Sèverine, also referred to as Sèverine Howell-Meri, the sole trader whose work is provided to the client.

2. Copyright

a. Ownership

  1. All copyright in the photographs taken during any session remains with Shot by Sèverine worldwide.

  2. Shot by Sèverine reserves the right to use any photographs from the session for promotional purposes, contests, samples, exhibitions, advertising and social media at any time without the client’s consent. Any uses outside of these areas will require consent from the client.

b. Usage Rights

  1. Non-Exclusive Rights

    • Reproduction rights granted are non-exclusive unless otherwise specified in the invoice.

    • Prohibited Actions: Screenshotting, downloading, or sharing any pictures, edited or unedited, provided by the photographer without explicit prior written consent is strictly prohibited. This includes sharing images on social media, websites, or other digital platforms without proper authorisation. Any breach of this term will result in immediate revocation of usage rights and may incur additional fees or legal action.

  2. Personal Use Only

    • Rights are personal to the client and cannot be transferred, loaned, or assigned to third parties, except where necessary for exercising the granted reproduction rights.

  3. Licensing Limitations

    • Reproduction rights are issued as a license, not as a transfer of copyright. No implied transfer of copyright occurs.

    • Shot by Sèverine may refuse to provide a reproduction license to a third party, even at the client’s request.

c. Moral Rights and Credit

  1. Shot by Sèverine asserts her moral right to be identified as the author of her work, in accordance with the Copyright, Designs and Patents Act 1988, sections 77 and 78.

  2. All uses of her images must include the agreed credit line.

  3. If credit is missing, the client will be charged an increased fee of at least 25% or as specified by Shot by Sèverine.

3. Permitted Use and Conditions

a. Types of Use

  • Headshot / Creative Portrait Usage: Photos may be used for personal promotion by the client (e.g., actors or models) on websites, Spotlight, Actors Access, other casting platforms, agent mail-outs, or front-of-house displays. This also extends to personal social media platforms (e.g., LinkedIn, Instagram) where the use supports the client’s professional career.

  • Advertising Restrictions: Use for paid advertisements, such as promotion or marketing of personal projects, releases, cover art, sponsorships, or endorsements is not included unless explicitly agreed upon with prior written consent and a license / usage fee. All use is subject to proper accreditation. Any image used outside of the agreed license will incur additional charges at the photographers discretion.

b. Editorial Use

  • Editorial placements (e.g., newspapers, magazines, or billboards) require prior written permission and a separate licensing agreement. If a third party (such as a theatre or publication) wishes to use the photos, they must contact ShotbySèverine directly to arrange a license and fee.

  • Cast announcements and creative project credits are allowed without additional licensing.

  • Third parties who use the pictures without prior written consent from Shot by Sèverine will be charged appropriate license and usage fees, determined at the sole discretion of the photographer.

4. Payment Terms for All Services


a. Full payment is required at the time of booking or by the session date as specified. Payment is processed via bank transfer, paypal or Shot by Sèverine’s website.


b. Deposits are non-refundable and non-transferrable under all circumstances. If the client reschedules a session, the deposit must be repaid.

Short-Notice Bookings

  • Sessions arranged with less than 48 hours' notice must be paid in full upfront. This payment in this circumstance is non-refundable. This must be agreed upon in writing between the photographer and the client.


c. If payment is not received within 2 working days after the due date, a £40 late fee will apply.


d. If payment is 4 days overdue, statutory interest of 8% + Bank of England base rate will apply until payment is received.

Legal Action for Outstanding Payments

  • Shot by Sèverine reserves the right to pursue legal action to recover outstanding debts, in accordance with the Late Payment of Commercial Debts Act 1998.

5. RAW and Unedited photos


a. No RAW or unedited photos will be provided under any circumstances.


b. Clients may select a set number of photos for retouching based on their chosen package. Only edited photos included in the package will be delivered.

c. Extra photos beyond the package allowance can be purchased for an additional fee, as outlined in the client’s booking confirmation. Prices are subject to change.

6. Editing and Retouching

a. Image Selection and Delivery

  • Shot by Sèverine will edit every take from the session and deliver the best selection of each situation covered via the online photo gallery.

b. Image Alterations

  • No picture may be altered, adapted, or edited in any way without written permission from Shot by Sèverine.

c. Unless a rejection fee is agreed upon in advance, the client has no right to reject photos based on style, composition, or editing.

7. Session Conduct and Safety


a. The client is responsible for the safety of all participants, especially children, during the session.


b. The photographer is not liable for uncooperative participants, which may affect the number or quality of final photos.

c. While Shot by Sèverine will take all reasonable care in fulfilling the agreement, she is not liable for any loss or damage suffered by the client or third parties resulting from the use or reproduction of any picture or caption.

d. The client agrees to indemnify Shot by Sèverine against any claims, damages, or costs arising from the reproduction of any image without proper licensing or reproduction rights.

8. Film Photography Disclaimer (If applicable)


a. The client acknowledges that film photography may yield varied results.


b. All delivered photos will meet the photographer’s quality standards, even if fewer than expected.

9. Event Deliverables


a. All deliverables must be agreed upon in writing (email or DM) before the event.


b. No additional deliverables will be provided unless confirmed in advance.

c. Copyright and usage terms in section 2 above apply to event deliverables.

10. Cancellation and Rescheduling


a. Changes made to any appointment will result in a deposit being recharged.

b. Same day reschedules will result in an additional £50 charge.

c. Same day cancellations or no-shows will result in the session fee being charged in full.

11. Legal Jurisdiction and Variation of Terms


a. This agreement is governed by English Law and subject to the exclusive jurisdiction of the Courts of England.


b. Any changes to these terms require written agreement from both parties.
